SMS / Mobile Terms of Service

Echo Technologies LLC, doing business as Echo Water (“Echo Water,” “we,” “us,” or “our”), operates an SMS and MMS text messaging program (the “Program”) to provide subscribers with marketing promotions, product announcements, cart abandonment reminders, order updates, and other communications related to Echo Water products and services.
By opting in to receive text messages from Echo Water, you agree to these SMS/Mobile Terms of Service (“SMS Terms”). These SMS Terms are in addition to, and supplement, our Terms and Conditions and Privacy Policy. Please read all three documents carefully. If you do not agree to these SMS Terms, do not opt in to our text messaging Program.
1. Program Description
When you opt in, you consent to receive recurring automated marketing and transactional text messages (SMS and MMS) from Echo Water at the mobile number you provided. These messages may include:
- Promotional offers, discounts, and sales announcements
- New product launches and restocks
- Abandoned cart reminders
- Order confirmations, shipping updates, and delivery notifications
- Customer service responses and account alerts
- Surveys, feedback requests, and wellness tips
Messages may be sent using an automatic telephone dialing system or other automated technology. Your consent to receive automated marketing text messages is not a condition of any purchase.
2. Opting In
You may opt in to our text messaging Program through one or more of the following methods:
- Entering your mobile phone number and providing consent on our website (e.g., via a pop-up form, checkout page, or dedicated sign-up page)
- Texting a keyword (e.g., “JOIN” or “ECHO”) to our designated short code or phone number
- Providing consent in-person or through a paper form at an event, retail location, or trade show
By opting in, you confirm that:
- You are the owner or authorized user of the mobile device and phone number you provide.
- You are at least 18 years of age (or the age of majority in your jurisdiction).
- You are a resident of the United States or Canada.
- You consent to receive recurring automated marketing and informational text messages from Echo Water, including messages sent by autodialer.
- You understand that consent is not required as a condition of purchasing any goods or services.
After opting in, you will receive a confirmation text message verifying your subscription. If you are subscribing to receive abandoned cart reminders, you may be asked to confirm your subscription through a double opt-in process as required by wireless carriers.
3. Message Frequency
Message frequency varies. You may receive up to approximately 10 marketing messages per month. Transactional messages (such as order confirmations and shipping updates) are sent as needed and are not subject to this limit. During promotional periods or sales events, you may temporarily receive a higher volume of messages.
4. Costs & Charges
Echo Water does not charge you for text messages sent through this Program. However, message and data rates may apply depending on your mobile carrier and wireless plan. You are responsible for any charges imposed by your mobile carrier, including fees for text messages, data usage, and any applicable roaming charges. Contact your mobile carrier for details about your messaging plan and pricing.
5. Opting Out
You may opt out of receiving text messages from Echo Water at any time by texting STOP to any message you receive from us. You may also text QUIT, END, CANCEL, or UNSUBSCRIBE to opt out.
After you send STOP, you will receive a single confirmation message acknowledging your opt-out request. After that, you will no longer receive marketing text messages from Echo Water unless you re-subscribe. Please note that opting out of SMS messages will not affect communications sent via other channels (e.g., email).
If you are subscribed to multiple Echo Water text messaging programs, you may need to opt out of each one separately.
Please allow up to 48 hours for opt-out requests to be fully processed. During this period, you may receive messages that were already queued before your request was received.

7. Abandoned Cart Messages
If you have opted in to receive text messages and you add items to your shopping cart on echowater.com but do not complete your purchase, we may send you SMS reminders about the items in your cart. Echo Water’s website uses cookies and similar tracking technologies to keep track of items you place in your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages via SMS.
For abandoned cart SMS messages, wireless carriers in the United States require that you go through a double opt-in confirmation process. You will receive a confirmation text after opting in, and you must confirm your subscription before receiving cart abandonment messages.
You may not complete a purchase via text message. All transactions must be completed through our website. We will never collect payment information via text or accept purchases through keyword responses.
8. Privacy & Data Protection
Your privacy is important to us. Our use of information collected through the Program is governed by our Privacy Policy. Key points specific to the Program include:
- We collect your mobile phone number and consent records (including timestamp, method of opt-in, and IP address where applicable) when you subscribe to our Program.
- We use your phone number solely to deliver the text messages described in this Program and for related customer service.
- We will not sell, rent, share, or otherwise disclose your text messaging originator opt-in data or consent to any third parties. This restriction is absolute.
- Mobile information collected in connection with this Program will not be shared with third parties or affiliates for their own marketing or promotional purposes.
- The above exclusions apply to all categories of data sharing described in our Privacy Policy. All such categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
- We may share your information with service providers who assist us in delivering messages (e.g., our SMS platform provider), solely for the purpose of operating this Program.
We reserve the right to disclose information as necessary to satisfy any applicable law, regulation, or governmental request, to avoid liability, or to protect our rights or property.
9. Supported Carriers
Our Program is supported on most major U.S. mobile carriers, including but not limited to AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, Cricket, Metro by T-Mobile, U.S. Cellular, and others. Supported carriers are subject to change. Carriers are not liable for delayed or undelivered messages.
10. Disclaimer of Warranties
The Program is offered on an “as-is” basis and may not be available in all areas at all times. We make no warranty, express or implied, regarding the Program, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that messages will be delivered, timely, secure, or error-free. Message delivery is subject to effective transmission by your mobile carrier and network conditions.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Echo Water, its affiliates, officers, directors, employees, agents, and service providers shall not be liable for any damages or losses of any kind arising from or related to your participation in the Program, including but not limited to:
- Direct, indirect, incidental, consequential, special, or punitive damages
- Any failure or delay in delivering text messages
- Any charges incurred by your mobile carrier in connection with text messages
- Any unauthorized access to or alteration of your communications
- Any errors, omissions, or inaccuracies in messages
12. Quiet Hours
In accordance with the Telephone Consumer Protection Act (TCPA) and state-specific regulations, Echo Water will not send marketing text messages before 8:00 a.m. or after 9:00 p.m. in the recipient’s local time zone. Some states impose stricter time restrictions, and we comply with all applicable state quiet-hours laws, including but not limited to Florida’s mini-TCPA (which limits marketing messages to 8:00 a.m.–8:00 p.m.).
Transactional messages (such as order confirmations and shipping updates) may be sent outside of these hours when necessary.
13. Changes to These Terms
Echo Water reserves the right to modify these SMS Terms at any time. If we make material changes, we will notify you by text message or by posting the updated terms on our website with a new “Last Updated” date. Your continued participation in the Program after such changes constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you may opt out by texting STOP at any time.
14. Dispute Resolution
Any disputes arising from or relating to these SMS Terms or the Program shall be governed by the laws of the State of Utah, without regard to conflict of law principles. You agree to resolve any disputes through binding individual arbitration in accordance with the rules of the American Arbitration Association, unless you opt out of arbitration within 30 days of first opting in to the Program by sending written notice to legal@echowater.com.
Class Action Waiver: To the fullest extent permitted by law, you agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of the arbitration provision shall be null and void.
15. Eligibility
The Program is available to individuals who are at least 18 years of age and reside in the United States or Canada. By opting in, you represent and warrant that you meet these eligibility requirements. If we learn that a subscriber does not meet these requirements, we will promptly remove them from the Program.
16. Termination
We may suspend or terminate your participation in the Program at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, suspected fraud, abuse of the Program, violation of these SMS Terms, or changes in the availability of the Program. Your participation in the Program will also terminate if your mobile phone service is cancelled or if your phone number is reassigned to another user.
